Florida High School Wins Case for Pro-Gay Speech

On July 24, 2008 a Florida judge ruled in favor of LGBT ally Heather Gillman who had sued the Holmes County, FL School Board for banning pro-gay rights expression at the Ponce de Leon High School in Panama City, FL where she attended. Judge Smoak also awarded all of Gillman’s $300,000 in attorney fees to the school board as punishment for what has been described as a “witch hunt” at the high school.

In September of 2007, a 12th grade student identified as “Jane Doe” reported to a teacher’s aid at Ponce de Leon High School that she was being harassed by five other students because of her sexual orientation. The aid then reported the situation to Principal David Davis who quickly called Jane into his office and interrogated her about the teasing and her sexual orientation. He then said that she had no “right” to be homosexual and asked if her parents knew. When Jane said that she had not come out to her parents, Principal Davis called them and told them. Jane’s father then threatened to kick her out of the house, a very scary reality for some lesbian, gay, bisexual and transgender (LGBT) youth.

When other students began to vocalize their disagreement with Davis’ actions and began circulating petitions and making signs in support of Jane, Davis then interrogated 30 participating students about their sexual orientations. He then issued a ban on any pro-gay messages in the school. Over the next few days, Davis suspended 11 students, including Gillman’s lesbian cousin. Principal Davis also told the mother of one of the 11 students that he could secretly “send her [daughter] off to a private Christian school” or to juvenile detention and that “if there were a man in her house, and her children were in church, she wouldn’t be having any of these gay issues.”

When students complained to the School Board about Davis’ action, they backed up Davis which then sent LGBT ally and friend Gillman to the American Civil Liberties Union (ACLU) to see if they would take her case. After taking her case and in their search for evidence, the ACLU discovered that Davis is an Evangelical Christian with strong moral opposition to homosexuality and open gender expression. Davis also believed that is was fair for him to apply his moral beliefs through his work in a public school.

Under the First Amendment principles of the U.S. Constitution, high school students are within their rights to engage in speech that is not disruptive of academic or educational programs. Judge Smoak ruled that Davis’ suppression of free speech was a First Amendment violation, and that the principal himself “bears sole responsibility for any unrest that occurred at Ponce de Leon High School in September 2007.” This ruling is a huge victory for LGBT high school students and their allies like Heather across the country.

According to the ACLU and federal mandate, “teachers and other school officials do NOT have the right to ‘out’ you to anyone without your permission or use your sexual orientation to manipulate you in any way.” It is also every public school student’s constitutional right to be open and out about their sexual orientation or gender identity, in addition to expressing opinions related to sexual orientation or identity. According to the Equal Access Act, “public high schools that allow students to form non-curricular clubs must also allow students to start gay-straight alliances (GSAs).” Finally, public schools cannot forbid you from taking a same-sex date to prom as that would be an infringement on your right to freedom of expression.

god in my school yea, other students bully LGBTs, but at least staff stays out of it. it sucks that people think it you have no "right" to love who you love.

How awful it would be to report bullying and your principal just bullies you more! People like this should not be able to work in public schools. Well, I know a lot of people are school officials that are homophobes, but they should NOT be able to enforce their hateful ideas upon children who are just asking to be treated fairly as any other student would be.

this story make me appreciate my school (west covina high school) even more, i'm so lucky to not have to deal with this b.s. cuz i go to a school that for the most part is very loving and open-minded, with the exception of some assholes, this has really open my eyes to what some people have to go through and it just saddens me. But i happy that in end the principal was called on his bullshit, and i have the urge to hit him in the face with a hammer!

F*ck homophobes and their unreasonable hatred. People need to grow up, especially the adults, which is honestly very embarrassing and sad. They should be our role models, which is obviously our problem here. That principal is a disgrace to society. Hope he learns what its like to be hated by people you don't even know.

It really is unbelievable what this country is able to do as far as restricting the rights of gays and talking about gays...unfucking believable. At least they overturned it...but the fact that the school wouldn't allow it at first is unbelievable to me.

It truly is shocking to me that in a country where there is supposedly a separation of church and state people still think that enforcing your moral ideas is OKAY!

My heart goes out to Heather- to be outed is often a traumatic experience on its own and to have it done against her will is a thousand times worse.

poor girl, this stuff is always happening...
not that long ago the editor in chief from our school's newspaper was forced to give up her position due to an article where 3 openly gay students talked about their orientation. Supposedly these kids had no right to have it published without their parents' consent.

The advisor was forced to retire as well for overlooking this fact...


* my school lies in conservative and homophobic (for the most part) fullerton. parents complained, and they found some scape goats.



and it was actually a really good article.

Geez, I live in Montana and I thought people here were pretty close minded, but I mean WOW. At my school there is a lot of bullying and teasing, but if you go to a teacher they usually put a stop to it right away. Plus I go to a pretty conservative High School with a lot of really wealthy right winged families, but we still have nothing this bad. I feel so bad for all of those students. I'm glad that they were able to win the case though, they definitely deserved that much

Whoa. Some principal...I live in NYC, so everyone's pretty open here. In my school, some of my teachers know I'm gay and they honestly don't care. It's great that the kids won the case, though. ^___^

Wow, i live in Florida and that stuff happens all the time at my school. Not necessarily to that extent but straight people are always ridiculing others because they aren't straight. Its so stupid for people to be so close minded. And this is just one more reason why people should separate religion from their work, unless you work at a church =P

Joshua I am sorry that happened to you, I am a Christian but I am an Anglican and we are very gay friendly we have an openly gay bishop! I apologize to you on behalf of all of Christians who have hurt you.

i also live in florida.
and the ACLU is investigating my school because of these very same things.
my now previous princpal(i switched schools because of the incidents) is also an evangelical christian and interrogated about my sexaul orientation.
she also threatened to tell my parents,
and i told her to do so,
cause not only did my mom know,
but she loves me and supports me 100% and she's the reason why i'm standing up to you.
yeah.
crazy stuff.
and now the ACLU is investigating the school.
lawmakers and politicians and mayors and parents all need to know this harsh reality.
i think this ignorance occurs because schools don't teach tolerance of everyone. schools don't specifically touch base on sexuality like they should.
and there's no way to regulate the actions of people in charge.
and things get out of control when the people in power are the people who're against the right thing.
we should be making sure tolerance is on the list when these school boards hire these so called "principals"...
haha.

My high school would not let us make a GSA for 3 years in a row and now I finally graduated and I dont think that school will ever get a GSA. While it is in Texas, there are other schools in the same district that started GSAs. the problem at my school was the principal was scaring any teachers that would try to support our club, and without a teacher you can't make it.

This gives me real hope for my school. I'm glad they won and Davis is a complete jerk. Do we know if he was fired? I hope so. I doubt my school would me do that stuff. We are super close-minded. It's sad really. No matter, it will all change when they see the real world.

It's good that they won, but honestly it's so pathetic that THIS is a big step. This kind of stuff should be a given. We should be in shock that Davis broke the law, not that Gillman won the lawsuit. Alas, we aren't in a perfect world yet. But we will be.

Dude, that sounds like something that would totally happen at my school. Everyone is closed-minded and racist. Religion has some to do with it, but not all, so i cannot say it is a religious thing at our school. However, the LGBT in my school DOES feel threatened, and maybe since this school got over it, maybe mine can too?

This is amazing. What a big step for the LGBT community, youth and adult. I can guarantee almost all LGBT adults could remember some type of harassment they had to endure growing up, whether they were out or not. I was never out growing up in public school, but the mere fact that I was different than everyone else sparked the harassment for me. I am very happy to hear that the judge ruled in favor of the LGBT community.
